The article submitted following these guidelines and those in the “Superhero essay competition: tell us your favorite superpower” blog post shall be collectively referred to herein as the “Submissions” or each as a “Submission.”
By entering the competition you confirm that:
By entering the Contest you hereby warrant and represent the following with respect to your Submissions: (a) you are the sole and exclusive owner of all rights in the Submission; (b) the Submission is your own creation and is your original work; (c) the Submission will not infringe on any rights of any third party including but not limited to copyright, trademark, privacy, publicity, any other intellectual property rights, and any other rights whatsoever; (d) the Submission complies with the Submission Guidelines (set forth below); and (e) the Submission has not been submitted previously in any contest, sweepstakes or promotion of any kind, has not won any award and/or been used publicly other than by the entrant through any means whatsoever.
Each entrant acknowledges that other entrants may have used ideas and/or concepts in their Submissions that may be similar in idea or concept to what is included in entrant’s Submission. Each entrant understands and agrees that he/she shall not have any claim against any other entrant or Sponsor arising out any such similarity or be entitled to any compensation because of any such similarity. Sponsor shall not be liable or responsible in the event any winner’s Submission is not used for any reason. Submissions may be cut, edited, reformatted, rearranged, combined with other materials and/or otherwise modified, in Sponsor’s sole and absolute discretion. Each entrant agrees and acknowledges that nothing herein shall prevent Sponsor from using any material in or similar to the Submission including, but not limited to, if Sponsor has or has determined that it has an independent legal right to use such other material, including without limitation, because such features or elements were not new or novel, or were not originated by entrant, or were or may hereafter be independently created by or submitted to Sponsor.
You give us permission to publish the submission on the OUPblog. There will be no payment for publication online. You consent to your name being published alongside your submission. Acceptance of the prize constitutes permission for Sponsor and its employees to use winner’s name for this purpose. You retain ownership of the copyright for your submission as its author and you can publish it elsewhere.
Approximate Retail value (“ARV”) of the prize is $100.00. The prize must be accepted as offered. There can be no alternative awards, cash or otherwise, except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute the prize (or any portion thereof) with one of comparable or greater value at its sole and absolute discretion. The Winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). Sponsor will pay for reasonable shipping costs to send the prize to the prize Winner located in the fifty (50) United States, using a shipping method of its sole choosing. All costs and expenses associated with the prize acceptance and use not specified herein as being provided including, but not limited to, any and all expenses incurred by accepting the prize are the sole responsibility of the prize Winner.
The Sponsor reserves the right to amend the specification of the prize or offer an alternative prize of equal or greater value. If the promoter is not able to run the competition as planned due to unforeseen circumstances, they can alter, amend, suspend or cancel the competition without prior notice.
Only one entry per person is permitted: multiple entries will be disqualified.
Automated/bulk entries from third parties will be disqualified.
Entrants must be over 18 years old.
The contest is open to everyone except employees of OUP or anyone connected with this offer.
For name/county of prize winners, please send a stamped addressed envelope marked Competition Winner to Oxford University Press, Publicity Department, 198 Madison Avenue, New York, NY 10016, USA.
All entries received will be judged by a panel of judges. The judges’ decision is final and no correspondence will be entered into.
Each entrant will be entered into the Contest once only, regardless of how many Submissions s/he makes. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. No responsibility is accepted for entries lost, delayed, mislaid or for any technical failure or for any event which may cause entries to the competition to be delayed, deleted, misdirected, disrupted, or corrupted. In the event of a dispute as to any entry, the authorized account holder of the email address associated with the entrant’s Submission will be deemed to be the entrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations or any other methods will void that entrant’s entry.
The prize Winner will be notified by email by April 22nd, 2013 and may be required to sign and return a notarized Affidavit of Eligibility, a Liability Release, where legally permissible a Publicity Release, and a completed IRS W-9 form within seven (7) days following the date the email notification is sent. Failure to comply with this deadline, return of any prize/prize notification as undeliverable, Sponsor’s inability to contact a potential prize Winner within a reasonable time period, or any potential prize Winner’s noncompliance with these Official Rules may result in disqualification and, at Sponsor’s discretion, selection of an alternate winner from among all non-winning entries received. Sponsor’s decisions are final.
GENERAL CONDITIONS: Entrants must have valid e-mail address and it is entrant’s responsibility to update Sponsor of any change in e-mail address.Sponsor is not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Contest, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Contest or downloading any materials in this Contest. Sponsor reserves the right to cancel, in its sole discretion, to suspend and/or modify the Contest, or any part of it, if any fraud or any other factor beyond reasonable control impairs the integrity or proper functioning of the Contest including but not limited to virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Each prize Winner is responsible for all applicable federal, state and local taxes. Each prize is awarded “as is” with no warranty or guarantee, either express or implied. If a winner cannot be contacted from the information provided form by the electronic entry, Sponsor reserves the right to select another winner at its sole discretion. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Moreover, Sponsor has no liability and will make no refund in the event of any defector other events beyond its direct control. Sponsor is not responsible for prize quality, utility or functionality. IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SERVICE AND/OR THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATES WITH THE CONTEST. WITHOUT LIMITING THE FOREGOING, THIS CONTEST AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. · The Submission must be in document format.
· The Submission must be in English.
· The description contained in the Submission should be between 100 and 500 words.
· The Submission must not contain material that violates or infringes any rights of any other party, including but not limited to copyright, trademark, privacy, publicity or any other intellectual property rights;
· The Submission must not in any disparage Sponsor, any other person or party affiliated with the promotion and administration of this Contest;
· The Submission must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;
· The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations of the United States or of any jurisdiction where Submission is created;
· The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
· The Submission must be consistent with the image and values of Sponsor and be consistent with and satisfy the purpose of the Contest.
By fully completing and submitting all required information as directed you will be entered in the Contest. Email entries only. No other method of entry will be accepted.
